The following is the privacy policy (“Privacy Policy”) of ePharmacies, (“ePharmacies,” “our,” “us,” or “we”). This Privacy Policy sets out how we look after your Personal Information when you visit www.ePharmacies.com (our “Website”), use our services, or otherwise share your Personal Information with us. So that we can perform our services under the Agreement (the “Services”), we may ask you to provide your name, a method by which to contact you (such as a telephone number or email address), your location, certain protected health information (“PHI”), non-public personal information, credit card information, and other information (collectively, “Personal Information”).

We will process your Personal Information for the following purposes as is necessary for the performance of a contract between you and us (i.e. the Agreement), or to answer questions or take steps at your request prior to entering into a contract:

• To create and administer your account;
• To fulfill our obligations under the Agreement; and
• To notify you about changes to our Services, and to send you service emails relating to the activities you have asked us to undertake on your behalf.

We will process your Personal Information for the following purposes as necessary for certain legitimate interests, and where you have given your express, informed consent to such processing as required by applicable law (such consent can be withdrawn at any time):

• To resolve any disputes;
• To ensure the security of your account and our business, preventing or detecting fraud or abuses of our Website;

ePharmacies is not a prescription drug manufacturer or distributor and does not offer medical advice or provide prescriptions. ePharmacies may occasionally send informational emails, such as newsletters, to registered users. To opt out of these informational emails, please follow the “unsubscribe” directions in those emails.

If we make functionalities available that permit you to access certain features of the Website that require a username and password login, you will be responsible for selecting and keeping your username and password confidential. You may not share or disclose your username or password to anyone other than ePharmacies. You understand that you are responsible for all uses of the Website through your username and password. You must notify ePharmacies immediately if you know of or suspect unauthorized use of your username and password for this Website.

4. Updates to Privacy Policy

ePharmacies reserves the right to amend the Website, the Agreement, and this Privacy Policy at its discretion from time to time. We will provide you with material updates to the Website, Agreement, and this Privacy Policy to the email address you provide us upon entering into the Agreement or to such email address as you may provide us thereafter in accordance with this Privacy Policy, prior to the change becoming effective. 

NiceRx may, but is not obligated to, offer upgrades, updates, and improvements to the Website, and to add or discontinue any Services at any time.

5. HIPAA

We shall comply with applicable Health Insurance Portability and Accountability Act (“HIPAA”) laws. We do not collect any personal health information from each individual member. All credit card information that we collect is collected by our third-party credit card processor. We will not use or disclose your non-public personal information or PHI other than as permitted or required by law or by the Agreement. 6. Children’s Privacy 

Our Website and the Services are directed to people who are at least 18 years old and have the legal capacity to enter into the Agreement for themselves or someone else, such as for a minor child as a parent or legal guardian, or as an attorney-in-fact or as permitted or required by applicable law. ePharmacies does not knowingly collect Personal Information from anyone under the age of 18 unless permitted or required by law. If you are aware that ePharmacies has collected Personal Information from someone under the age of 18 for a reason not permitted by this Privacy Policy or applicable law, please alert us at info@epharmacies and the information will be removed from our system immediately.

7. Personal Information Shared with Third Parties 

Except as expressly provided in this Privacy Policy or the Agreement, ePharmacies will not share your Personal Information with unaffiliated third parties without your permission.

ePharmacies will share your Personal Information with subsidiaries, branches, or associated offices. We will also share your Personal Information with our service providers to provide the Services, it is understood that ePharmacies contracts with such service providers to provide certain aspects of the Services. These kinds of disclosures will occur as part of our “Healthcare Operations,” as contemplated by 45 CFR 164.501.

ePharmacies does not sell your Personal Information to third parties. ePharmacies may provide aggregate statistical information (such as the city or state in which you live) to third parties to describe ePharmacies.com’s services to prospective partners, advertisers, and other third parties, and for other lawful purposes. ePharmacies will not, however, disclose any personally identifiable information to these parties without your express permission or as permitted by this Privacy Policy.

You understand and agree that we monitor usage of the Website and the Services and that we may share your use of the Website and Services, including Personal Information, with law enforcement agencies and officials in response to inquiries or if we have reason to believe that your use of the Website and Services is for an unlawful purpose. We may also share your use of the Website and Services, including Personal Information, to third parties without your prior consent as required by law, a court order, a subpoena, legal process, governmental request, to investigate fraud, or as ePharmacies determines is necessary or advisable to prevent crimes or to protect your safety or the safety of others.

We may share your Personal Information with third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them and may share your Personal Information as part of that process. We may also share Personal Information with affiliates in the context of a business reorganization or group restructuring exercise. If a change happens to our business, then the new owners may use your Personal Information in the same way as set out in this Privacy Policy. If NiceRx is involved in a merger, acquisition, or sale of all or substantially all of its assets, you will be notified via email or through a prominent notice on our Website of any change in control of NiceRx or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

We may also provide your Personal Information to companies that provide services to help us with our business activities such as hosting providers or analytics providers. These companies are authorized to use your Personal Information only as necessary to provide these services to us.

8. Retention of Your Personal Information

We will retain your Personal Information for as long as your account is active or as needed to provide you Services, or as permitted or required by applicable law. We will retain and use your Personal Information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Subject to your right to remove Personal Information as described below and our right to remove information you post to our Website in violation of the terms of this Privacy Policy, your posted information may remain on the Website in perpetuity. ePharmacies reserves the right to remove your posted information at any time for any reason.

ePharmacies uses cookies on the Website. A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use both session ID cookies and persistent cookies. A session ID cookie expires when you close your browser. When you log in to the Website the session ID cookie allows us to maintain a unique and secure (encrypted) connection with the user. A persistent cookie remains on your hard drive for an extended period of time. 10. “Do Not Track” Disclosure

Certain web browsers may allow you to enable a “do not track” option that sends signals to the websites you visit indicating that you do not want your online activities tracked. This is different than blocking cookies as browsers with the “do not track” option selected may still accept cookies. We currently do not honor “do not track” signals. If we do so in the future, we will update this Privacy Policy accordingly.

The Website may contain links to other websites. Unless expressly stated,  ePharmacies does not intend those links to be referrals or endorsements of the linked entities. Some links are directed to affiliated third parties for the provision of Services. All other links are provided because they may be of interest to you and other ePharmacies users. ePharmacies is not responsible for the privacy policies or content of other websites. We encourage you to carefully read the privacy policy of any website you visit. If you choose to tell a friend about our Services or Website, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Website. ePharmacies stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. Your friend may contact us at info@epharmacies.com to request that we remove this information from our database. Our Website may include social media features, such as the Facebook Like button, the Twitter button, or interactive mini-programs that run on our Website. These features may collect your IP address, and which page you are visiting on the Website, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on the Website. Your interactions with these features are governed by the privacy policy of the company providing them. If we offer a feature that permits you to log in to the Website using sign-in services such as Facebook and Google, your interactions with their features are governed by the terms of use policies of such companies, as well as this Privacy

The security of your Personal Information is important to ePharmacies. When you enter sensitive information such as a credit card number to receive the Services, we encrypt the transmission of that information using secure socket layer technology (SSL). ePharmacies follows generally accepted standards to protect the Personal Information you submit to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

13. Posted Information

If we offer a public message board feature on the Website, your voluntary disclosures of Personal Information on the Website’s message board may be collected and used by others. ePharmacies will not, however, include any Personal Information on our message boards unless you specifically include it in the content of your posting. To request removal of your Personal Information from our blog or community forum, contact us at info@epharmacies.com. In some cases, ePharmacies may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so.
